Zoning Ordinance Commissioners discussed the recent Zoning Board of Appeals meeting and application of the BHV Zoning Ordinance.

--Section 5.03 B regarding chimney height states that a chimney may exceed the height limit of the district by up to five feet. In the ZBA review this was interpreted as total roof height plus chimney height could be no more than 45 feet (40’ roof + 5’ chimney), where the roof height was less than 40’ and the chimney height was greater than 5’ but the total height was under 45’. The Commissioners agreed the potential for a lower roof height with a very tall chimney was not the intent so Section 5.03 B should be amended in the future to read roof ridge rather than height limit that a chimney may exceed by 5’. The fire code will also be checked to see if 5’ is the correct number to be consistent with code requirements for chimneys.

--In discussing a variance application for construction in the side set back it was noted that Section 5.07 allows for accessory structures to be as tall as the primary structure, and that a 40’ accessory building within 20’ of a property line may not be desirable. However, increasing the overall set back may create more difficulties due to the wide variety of properties in BHV. It was agreed that accessory structure regulations should be discussed further. Wallace arrived

Ann Arbor Township ZA Perry mentioned topics being discussed in Ann Arbor Township that may have relevance to BHV.

--Building Inspector Hamlin is leaving later in March and the Township has contracted with Carlisle/Wortman to conduct zoning review. BHV will need to explore what implications this will have for the Village project review process. Mr. Perry will contact Carlisle/Wortman about meeting with the Planning Commission to discuss the company’s services.

--The Township is also investigating the dioxane plume, and area internet providers. Mr. Perry will be following those discussions relative to BHV as well.

The meeting was adjourned at 6:55 PM. (JMacKrell/Weingartner/P unanimously)

Janice K. Esch, Assistant Secretary
